Safety, Risk Assumption, Community Content, and Liability

Welcome to Glassy. These Terms of Use ("Terms") govern your access to and use of the Glassy website, app, alerts, maps, scores, briefings, forecasts, check-ins, community features, and related services (collectively, the "Service"). By accessing or using Glassy, you agree to these Terms.
1. Nature of the Service
Glassy is an informational and planning tool designed to help users evaluate lake-related conditions, timing, and recreational opportunities. The Service may include lake scores, forecasts, best-window guidance, maps, weather-related content, water-related information, night-sky information, alerts, community updates, and similar content.
Glassy is not:
an emergency warning system
a rescue or dispatch service
a substitute for personal judgment
a substitute for official warnings, posted notices, or on-site observation of actual conditions
All content made available through the Service is provided for general informational and planning purposes only.
2. No Safety Guarantee
Glassy's scores, briefings, alerts, maps, forecasts, activity windows, stargazing information, lake-condition summaries, check-ins, community reports, and related content are planning aids only. They do not guarantee safety, navigability, water quality, lake access conditions, launch availability, dock, restroom, parking, wash-station, or beach availability, weather conditions, visibility, algae conditions, fishing, boating, or swimming conditions, or suitability of any lake, route, shoreline, cove, bay, or activity. Conditions may differ materially from information shown in the Service.
3. User Responsibility
You are solely responsible for your decisions, conduct, and activities on or near the water. You agree that before and during any activity, you will use your own judgment and independently evaluate actual conditions, including weather, water, access, visibility, traffic, posted notices, official warnings, and any hazards present at the time and place of use. You will not rely solely on Glassy for safety-critical, navigation, emergency, hazard-avoidance, rescue-related, or personal-safety decisions.
4. Assumption of Risk
Outdoor and water-based activities involve inherent and potentially serious risks, including risks of injury, illness, property damage, and death. These risks may include, without limitation: changing weather, strong wind, chop, waves, wakes, and rough water, cold water, poor visibility, lightning and storms, tornados, harmful algal blooms, underwater hazards, shoreline hazards, currents, boat traffic, crowding, equipment failure, wildlife, slips, falls, collisions, or submersion, and nighttime and low-light hazards. By using Glassy, you knowingly and voluntarily assume all risks arising from or related to your use of the Service and your participation in outdoor or water-based activities.
5. Rapidly Changing Conditions
Lake, water, and weather conditions can change rapidly and unpredictably. Conditions may worsen between the time information is displayed in the Service and the time you arrive, launch, enter the water, or continue an activity. Forecasts may change, alerts may be delayed, on-lake conditions may vary by shoreline, cove, bay, or exposure, and community updates may be incomplete or outdated.
6. Third-Party Data and External Sources
Certain content in the Service is sourced from third-party providers. Glassy does not warrant the accuracy, completeness, timeliness, or availability of any third-party data.

National Weather Service & NOAA
Weather conditions, forecasts, wind data, and safety advisories including Small Craft Advisories and storm warnings.

State Departments of Natural Resources
DNR lake data including fish stocking records, water quality surveys, invasive species advisories, and public access information.

Public health agencies
Harmful algal bloom (HAB) advisories and swimming or contact-water health notices.

Map and location providers
Lake boundary data, GPS coordinates, and mapping layers used in the Lake Library and lake map features.

Astronomical and moon-phase sources
Sunrise, sunset, golden hour, and lunar data used in the daily briefing and hourly conditions chart.
7. Community Check-Ins and User-Generated Content
User-generated content including check-ins, location tags, comments, condition reports, ratings, photos, and updates is not verified by Glassy. It may be inaccurate, incomplete, misleading, outdated, biased, or otherwise unreliable. Do not rely on community content as a substitute for your own judgment or on-site assessment. If you submit content to Glassy, you represent that you have the right to submit it and that it does not violate any law or third-party right.
8. Alerts, Notifications, and Briefings
Glassy may send push notifications, alerts, summaries, warnings, or daily lake briefings. These may be delayed, interrupted, incomplete, inaccurate, not delivered, or no longer current when received. The absence of an alert or warning does not mean conditions are safe. Notifications and briefings are convenience features only.
9. No Professional Advice
Nothing in the Service constitutes legal, medical, rescue, certified meteorological, or navigation advice, professional safety advice, law-enforcement direction, or lifeguard or emergency services. Any decision to travel, launch, boat, swim, fish, remain on the water, or engage in related recreation is solely your responsibility.
10. Limitation of Liability
To the fullest extent permitted by law, Glassy and its owners, operators, affiliates, officers, directors, employees, contractors, licensors, partners, and data providers shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages arising from your use of the Service, reliance on any content, inaccuracies in third-party data, unreliability of user-generated content, your decisions or activities on or near the water, or hazardous or changing real-world conditions. Where liability is found, it shall not exceed amounts paid to Glassy in the preceding twelve months.
11. Indemnification
You agree to indemnify, defend, and hold harmless Glassy and its owners, operators, affiliates, employees, contractors, licensors, and data providers from any claims, liabilities, losses, damages, judgments, costs, and expenses, including reasonable attorneys' fees, arising from your use of the Service, your activities on or near the water, your violation of these Terms, your submission of user-generated content, or your infringement of any third-party rights.
12. User Acknowledgment
By using Glassy, you acknowledge that Glassy is an informational and planning tool only and not a safety authority, that you are solely responsible for your decisions and conduct, that outdoor and water-based activities involve inherent risks you assume, that you will not rely solely on Glassy for safety-critical decisions, and that user-generated content and third-party information may be delayed, inaccurate, or incomplete.
13. Changes to These Terms
Glassy may update these Terms from time to time. Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.

SMS Terms & Conditions

Program Description
The Glassy SMS program (operated by Glassy Outdoors) delivers daily lake-day briefings and severe-weather safety alerts to opted-in users in the United States. Briefings include the day's lake-day score, best activity windows, water and weather conditions, and a link to view the full briefing in the Glassy app.
Opt-In
You opt in to receive SMS messages from Glassy by selecting "SMS" as your preferred delivery channel during onboarding or in your Profile Settings within the Glassy app at
glassylakes.com, providing your mobile number, and tapping "Confirm SMS Subscription." A one-time verification code is sent to confirm the number before any briefings are delivered. Consent to receive SMS is not a condition of purchase or use of the Glassy service — you can use Glassy with email or push notifications instead.
Message Frequency
You will receive up to one (1) daily briefing per lake you follow (typically 1–5 messages per day depending on how many lakes you have saved), plus event-based severe weather and safety alerts when hazardous conditions are forecast or active for one of your followed lakes. Safety alerts are not capped in frequency but typically average fewer than 5 per month per lake.
Message and Data Rates
Message and data rates may apply. Glassy does not charge a fee to send SMS messages, but your wireless carrier's standard messaging and data rates will apply to each message you send or receive. Contact your wireless carrier for details on your plan's SMS and data charges.
Opting Out
You can cancel the SMS service at any time. To opt out, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any Glassy SMS message. After you send the opt-out message, we will send you a confirmation message confirming your unsubscription. After this, you will no longer receive SMS messages from us. You can also disable SMS at any time from your Profile Settings within the Glassy app.

Privacy and Non-Sharing of Mobile Numbers
Glassy Outdoors does not sell, rent, share, lease, or otherwise transfer your mobile phone number, the contents of your SMS messages, or any personally identifiable information associated with your SMS subscription to any third party for any purpose other than what is strictly necessary to deliver the SMS service to you (e.g., our SMS service provider, Twilio, processes messages on our behalf and is contractually prohibited from using your number for any other purpose). Your mobile number and SMS opt-in status are not shared with affiliates, partners, advertisers, or marketers under any circumstances. See our

Supported Carriers
The Glassy SMS program is supported by major U.S. wireless carriers, including AT&T, Verizon, T-Mobile, Sprint, Boost, Cricket, MetroPCS, U.S. Cellular, Virgin Mobile, and others. Carriers are not liable for delayed or undelivered messages.
Eligibility
You must be at least 13 years of age, be the account holder or have permission from the account holder of the wireless device on which you receive SMS messages, and reside in the United States to use the Glassy SMS service.
Changes to These SMS Terms
We may update these SMS Terms from time to time. We will notify you of material changes via an SMS message or a notice on the Glassy app or website at least 14 days before the changes take effect. Your continued use of the SMS service after the effective date constitutes acceptance of the revised SMS Terms.
